How to Choose the Right Texas Criminal Attorney

Felony Criminal Cases in Texas

Felony criminal cases in Texas all follow a basic pattern. They usually begin with an investigation. During an investigation, the police gather physical evidence and talk to witnesses, among other things.

After the police gather evidence, a prosecutor will examine the evidence to determine whether it is sufficient to prove in a court that you have committed a crime. If there is sufficient evidence, the prosecutor will file an Information. (An Information is a document that legally charges you with a crime and explains what you are charged with.)

After filing the Information, you will appear before the Court for an Initial Appearance. During your Initial Appearance, the judge will read the charges to you, although the judge will not normally accept a plea at this time. This is also likely the first formal opportunity you will have to request a public defender. (Keep in mind, you can (and should) hire or request an attorney during the investigation process.)

The next step is a preliminary hearing. This hearing is optional, and its purpose is to ensure the prosecutor can produce enough evidence for your case to go to trial. (Specifically, the prosecutor must demonstrate there is probable cause exists to show (1) a crime was committed, and (2) you were the one who committed that crime.) If the judge decides there is enough evidence, you will continue to trial. If the judge decides there is insufficient evidence, your charges will be dropped.

In a felony case, arraignment follows a preliminary hearing. During arraignment, you will most likely plead guilty or not guilty. If you plead guilty, the judge will schedule you for sentencing. If you please not guilty, the judge will schedule a roll call hearing.

At the roll call hearing, your attorney and the prosecutor will have the chance to sit down and discuss your case in hopes of resolving it before trial.

If the case cannot be resolved, a trial will be scheduled. Your attorney can file motions (e.g., motions to suppress, motions in limine) in preparation for trial. During trial, the prosecutor will call witnesses and produce evidence trying to prove you committed the crime you are charged with. Your attorney will also call witnesses, produce evidence, and argue you are not guilty. At the end of trial, a fact-finder (either a judge or a jury) will discuss the trial evidence and determine if you are guilty or not guilty.
